Confidential Waste Destruction - Data Protection Acts 1988 and 2003
The Data Protection (Amendment) Act, 2003 implements the European Data Protection Directive 95/46/EC. The Acts regulate how employers collect, store and use personal data held by them about their employees (past, prospective and current). More onerous obligations are imposed in respect of sensitive personal data. Infringement of the Acts can lead to investigation by the Data Protection Commissioner, fines of up to €100,000 or compensation claims from affected employees.
These laws also apply to information you hold for customers and suppliers so without the proper safeguard, companies not adhering to a programme of routinely destroying records are quite simply breaking the law. The list of documents and information that are deemed to be confidential and require securely shredding is endless.
